     Congress passed a bill in 1838 to provide pensions to soldiers who served in the American Revolution. Esther Rice Gale, who was a widow by that time, applied to the government for her husband's pension. Following is an exact transcript of this application: "Commonwealth of Massachusetts, Worcester County. On this 19th day of October, 1838, personally appeared before Ira Barton, Esq. Judge of the Court of Probate in the County of Worcester, Esther Gale, a resident in Petersham in said county of Worcester, aged 82 years, who being first duly sworn according to law, doth on her oath make the following declaration in order to obtain the benefit of the provision made by the act of congress passed July 7, 1838 entitled 'an act granting half pay and pensions to certain widows.'
"That she is the widow of Daniel Gale, who was a private in the Massachusetts state troops in the war of the Revolution; that the said Daniel Gale performed services as aforesaid in three separate campaigns; in the first, he was in Capt Jonas Hubbard's company, in Col. Timothy Bigelow's regiment, but the names of his officers in the other two she does not recollect; nor does she recollect the length of time he was in the service. She further declares that the said Daniel Gale was placed upon the pension list roll of the Massachusetts agency under the Act of Congress of June 7, 1832 at the rate of $53.33 by the year for services performed by him as a soldier in the war of the Revolution. She refers to the declaration of the said Daniel Gale and the documentary evidence therewith furnished, now in the war office to prove his services.
"She further declares that she was married to the said Daniel Gale on the 23rd day of October in the year 1778; that her husband, the aforesaid Daniel Gale died on the 12th day of July in the year 1834; that she was not married to him prior to his leaving the service but the marriage took place previous to the first day of January 1794.

The following is an exact transcript presented to Jared Weed, Justice of the Peace, by Esther Rice Gale's sister, Mary Rice Bancroft.
"I, Mary Bancroft, of Auburn in the county of Worcester, and Commonwealth of Massachusetts, aged 77 years, testify and say that I am the sister of Esther Gale of Petersham in this county; that her maiden name was Esther Rice; that I was present at her marriage with Daniel Gale; that they were married by William Young, Esq., a justice of the peace at my father's house in that part of the town of Worcester, which was afterwards Ward and now Auburn; that the marriage took place in the autumn of 1778 but the day and month I do not recollect. I recollect that it was in the autumn of that year because after their marriage they resided at my father's till the winter of 1780, the year of the great snow when they removed to Warwick. I know it was in the winter or spring of that year because they were delayed some time by reason of the roads being blocked up by snow and I know it was less than two years after the marriage because my sister then had but two children who were twins."

     Darius Rice was born on 2 November 1766 at Worcester (Auburn), MA.3,4 He was the son of Comfort Rice and Martha Morris.2 Marriage banns for Darius Rice and Hannah Stevens were published on 5 June 1789 at Ward (Auburn), MA; listed as Hannah of Newfane, VT.5 Darius Rice married Hannah Stevens on 5 June 1789 at Auburn, MA; Hannah of Newfane, VT, described by Ward incorrectly as Anna of Auburn.6,7,2 Darius Rice died in 1799 at Barre, MA; however, this seems unlikely, since he apparently had another son at

Hannah Stevens1

     Marriage banns for Hannah Stevens and Darius Rice were published on 5 June 1789 at Ward (Auburn), MA; listed as Hannah of Newfane, VT.2 Hannah Stevens married Darius Rice, son of Comfort Rice and Martha Morris, on 5 June 1789 at Auburn, MA; Hannah of Newfane, VT, described by Ward incorrectly as Anna of Auburn.1,3,4 Hannah Stevens died circa 1822 at Millbury, MA.5
     Note that the vital records of Ward (later called Auburn) uniformly refer to the wife of Darius Rice as Hannah, but records in Petersham and Millbury call her Anna. She resided at Millbury, MA.5 She was also known as Anna.6 She and Darius Rice resided at Barre, MA, according to Ward. However, the vital records show them in
Petersham and Auburn.5

     Erastus Rice was born on 1 August 1783 at Sandisfield, MA.3,4 He was the son of Abishai Rice and Elizabeth (?). Erastus Rice married 1st Mary Hulbert, daughter of Eliphalet Hulbert and Mehitabel (?), on 12 March 1812.5,2 Erastus Rice married Hannah Brown on 18 March 1829 at Sandisfield, MA; under the name Roberts.3,6,2 Erastus Rice died on 3 February 1864 at Newton, MA; from a heart attack.7,8 He was buried at Newton Cemetery, Newton, MA.8

Rebecca Ward married Phineas Gates, son of John Gates and Violata Rice, on 10 March 1788 at Worcester, MA; listed as Rebecca Wait (See Ward Family).1,3 Rebecca Ward died in 1848 at Oswego, NY; aged 72 (sic).1
     Rebecca Ward and Phineas Gates had 11 children.1 Your authors note that the age at death reported by Ward and the implied birth around 1776 are inconsistent with the recorded marriage of Phineas Gates to Rebecca WAIT (sic), but the 1768 baptism of Rebecca WARD fits. By the same token, Rebecca's father Uriah Ward had a different child baptized in 1776. Further research is needed to establish with certainty the sequence of events. Rebecca Ward and Phineas Gates resided at Petersham and Dummerston, VT.1 Rebecca Ward and Phineas Gates resided at Lewis County, NY.1

     Damaris Rice was born in 1761 at Rutland District (Barre), MA, (not found in the published records). She was the daughter of Ralph Rice and Sarah Sawyer. Damaris Rice married Benjamin Stuart, son of Joseph Stewart and Mary Snow, on 8 February 1787 at Barre, MA; listed as Benjamin of Leominster and Damaris of Barre.3,4,1,2 Damaris Rice died on 11 February 1841 at Sterling, MA; aged 79y,
under the name Stuart.5,6 She was buried at Chocksett Cemetery, Sterling, MA.5
     Damaris Rice was evidently living with her son Benjamin in 1840, according to
the census tallies. Her identification as the daughter of Ralph Rice is based on circumstantial evidence. In particular, she named one of her sons
Ralph Rice Stuart. However, that happened after Ralph Rice had already married her husband's widowed mother, and so an alternate interpretation is possible. Another piece of evidence is the fact that John Rice (WRN 1732), a son of Ralph, was living with the Stuarts at the time of the 1850 census. Again, this fact is suggestive but not conclusive, since John could instead have lived with one of his own children. Finally, Abel Rice (WRN 1731), who is believed to be another son of Ralph, named one of his daughters Damaris. Her son Benjamin Stuart was appointed administrator of her estate three
weeks after her death.7

Rebecca Rice married Asa Hemenway, son of Daniel Hemenway and Ruth Bigelow, on 8 February 1787 at Barre, MA; listed as Asa of Bridport (called 'Bradport' in the vital records).2,3
     Rebecca Rice and Asa Hemenway resided in 1788 at Bridport, VT, on land given to him by his father.4
